These Terms of Use govern access to and use of thevoyagebrief.com and related services operated by The Voyage Brief LLC. By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website.

Informational purpose

TVB provides editorial, research and traveler-submitted information about ocean cruises. TVB is not a cruise line, travel agency, booking platform, insurer or provider of legal, medical, financial or safety advice. Cruise schedules, sailing dates, duration, itineraries, ports, prices, packages, policies, entry requirements, accessibility features and onboard offerings may change or vary by ship, sailing, destination and traveler. Verify material details directly with the applicable cruise line, government authority or provider before booking or traveling. Links to official sailing pages are provided for convenience and do not mean TVB sells, books, modifies or services the sailing.

Eligibility and accounts

You may browse general content regardless of age, subject to applicable law. You must be at least 18 years old and legally able to enter an agreement to submit a Traveler Report, photograph or other public content. If account features are introduced, you are responsible for maintaining accurate information and protecting your credentials.

Permitted use

TVB grants you a limited, personal, revocable, nonexclusive and nontransferable right to access and use the website for lawful, noncommercial purposes, subject to these Terms.

Prohibited conduct

You agree not to:
Violate any law, regulation, contract, intellectual-property right, privacy right or other right.

Copy, scrape, harvest, republish, sell or commercially exploit substantial portions of the website except with written permission or as allowed by law.

Use bots, crawlers, scrapers or other automated tools to access, copy or extract website content or data, or use TVB content or data to train, fine-tune, test or develop artificial-intelligence or machine-learning models, datasets or services, except with TVB's prior written permission. This does not restrict ordinary search-engine indexing that follows our robots.txt instructions.

 

Circumvent access controls, interfere with security, introduce malicious code or overload the website.

Impersonate another person, submit false or misleading information or manipulate ratings and reports.

Upload unlawful, defamatory, threatening, discriminatory, obscene, invasive, infringing or dangerous material.

Collect personal information about others without authorization or expose sensitive personal information.

Intellectual property

Except for user submissions and third-party material, the website and its text, graphics, logos, design, databases, organization, software and other content are owned by or licensed to TVB and are protected by intellectual-property laws. No rights are granted except those expressly stated in these Terms. Brand names, ship names and third-party marks belong to their respective owners; reference to them does not imply sponsorship or endorsement.

Traveler Reports and other submissions

Traveler Reports, photographs and other public submissions are also governed by the Traveler Report Submission Terms and Content License, which are available on their own page and linked from the Traveler Report form. TVB may review, decline, edit as described in those terms, publish, unpublish or remove submissions, but does not promise to monitor all material. Opinions in Traveler Reports belong to the submitters and do not necessarily reflect TVB's views.

Third party links bookings and affiliate relationships

The website may contain links to third-party websites and services. TVB does not control and is not responsible for their content, availability, prices, terms, privacy practices or performance. Some links may be affiliate links, meaning TVB may receive compensation if you take an action or make a purchase. Any transaction is between you and the third party. Material relationships will be disclosed as described in the Affiliate Disclosure.

No warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TVB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY AND SECURITY.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TVB AND ITS OWNER, AFFILIATES, CONTRIBUTORS, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, TRAVEL DISRUPTION OR COSTS ARISING FROM OR RELATED TO THE WEBSITE, THIRD-PARTY SERVICES OR RELIANCE ON CONTENT. TVB'S AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO TVB DURING THE SIX MONTHS BEFORE THE CLAIM OR $100. Some jurisdictions do not allow certain limitations.

Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless TVB and its owner, affiliates, contributors, contractors and service providers from claims, losses, liabilities, damages and expenses arising from your unlawful use of the website, your violation of these Terms, or your submission's infringement or violation of another person's rights.

Changes suspension and termination

TVB may change, suspend or discontinue any part of the website and may restrict access when reasonably necessary for security, maintenance, legal compliance or enforcement. TVB may update these Terms by posting a revised version and updating the effective date.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any mandatory consumer rights, disputes will be brought in the state or federal courts serving Tioga County, New York.

General terms

If any provision is unenforceable, it will be modified only to the extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms, together with incorporated policies and any additional terms presented for a feature, form the agreement concerning use of the website.
